a first in the country. dana? >> so phil, the chief now answers to this compliance officer instead of the mayor. where is the mayor in all of this? >> reporter: the mayor is going to be right next to the chief because the compliance officer is going to not only be telling the chief what to do working with the chief on these matters but will have the direct say of the court, as well. they will be able to go with the court. the mayor is going to be quite honestly for this purpose off to the side. what oakland did however get away from was the courts coming in with a complete takeover of the department and that could have even led to the court saying you don't have enough cops on the street, you need to hire more. but for right now, it's strictly on the officers conduct not what's going on on the street in terms of crime. >> so the full takeover is still potentially on the table? >> reporter: it is. that's right. that's next. if this doesn't work, that could be, as well. >> , thank you, phil matier in oakland. >>> a recount in alameda county is called off. this is a story we first tol

daughter dana clair's lifeless bloody body on her daughter's bathroom floor in the wealthy san antonio neighborhood of alamo heights. >> kneeled on the floor next to her and pushed the towel off of her head. >> dana clair edwards had an mba and worked in the family's construction business. she had been beaten and strange told death. on top of that dana's beloved dog was later found battered to death in a nearby park. >> thanks for coming in. appreciate it. >> absolutely. >> in police interview dana clair's ex-boyfriend 43-year-old thomas ford looked shocked and in grief. >> oh, god. >> but the two had just broken up and that made ford a natural suspect. in the beginning of their investigation police had little to work with, just some grainy surveillance video taken outside dana clair's apartment building showing a vehicle which looked like ford's suv entering and leaving around the time of the murders. but dana clair's mother had followed the investigation and was convinced thomas ford was her daughter's killer. >> i wanted him to know i was thinking about him and that he needed to thi

just been found. good evening i'm ken bastida. does and i'm dana king. the couple have been missing since last week's storm. they were found in the snow. roderick and his girlfriend paula lain were last seen at this 7-eleven before leaving for nevada. 15 minutes ago we learned that a relative who was looking for the couple found paula. she was found crawling in the snow. tonight she is in the hospital. the condition of her boyfriend is not yet known. it appears the couple got snuck in the snow and roderick throat get help. he never returned to the car. investigators spoke just a few minutes ago. >> they may have been sightseeing and got stuck in the snow. reports are that they may have stayed in the vehicle for at least one night. roderick left the vehicle to seek help. when he did not return paula left to seek help. >> paula is in stable condition with mild frostbite. no official word yet about what happened to her boyfriend. >> developing news tonight. silicon valley tycoon john mcafee is under arrest. he's been on the run since early november, refusing to turn himself in to autho
